trademark assessment till its registration
with registrar. VA&A broadly undertakes
following functions for its clients in respect
of trademark.
Trademark Assessment:
The first step is to undertake the trademark
search in the records of Registrar of
Trademarks for the relevant classes before
filing the application to register a trademark
in order to make sure that there is no
identical or similar trademark already
registered or for which an application for
registration has been submitted.
Filing of Application:
The application to register the trademark is
filed with the Registrar of Trademarks in the
prescribed forms depending on the nature
of application such as Form TM-1, TM-2,
TM-3, TM-8, TM-51 etc. VA&A advises the
clients on nature of the mark and suitability
of the Form to be used for registration of
mark with registrar.
Meeting of the official objections:
The Trade Marks Registry sends the
"Official Examination Report" asking for
clarifications, if any, and also cites identical
or deceptively similar marks already
registered or pending registration. The
applicant has to overcome the objections.

Publication in the Trademark Journal:
The mark is thereafter published in the
Trademark Journal. After publication, if no
opposition to the mark is filed within 90
days from the date of publication, or 120
days if request for extension of time is given
by an opponent and opposition is refused,
mark proceeds for grant of registration
certificate. However, if it is opposed by a
third party, the registration is granted only
if the matter is decided in favour of the
applicant.
Trademark Registration:
After the objections are met, the trademark is registered and the trademark registration certificate is issued by the Registrar of
Trademarks. VA&A brings all the matters to
their final conclusion until this step.
